PRODUCT WARRANTY TERMS & CONDITIONS

1. DEFINITIONS AND SCOPE

“SOLID” refers to Solid Green Tech Solutions Sdn. Bhd., the manufacturer and supplier of the waterproofing products covered under this warranty.
“Client” refers solely to the party that has purchased the product directly from SOLID.
This warranty is strictly applicable to Clients only and shall not apply to any main contractors, subcontractors, third parties, or purchasers through indirect channels.

2. WARRANTY COVERAGE

2.1 SOLID warrants, subject to the conditions and exclusions herein, that the waterproofing product (“Product”):

  • Shall be free from material manufacturing defects; and
  • Shall perform in accordance with SOLID’s published specifications if stored, applied, and maintained strictly as per SOLID’s Technical Data Sheet (TDS) and written recommendations.

2.2 The warranty is only enforceable when an official Material Warranty Letter is issued by SOLID upon full completion of the prescribed warranty request process.

2.3 The warranty period shall commence from the date of Product purchase or the date stated in the Product Warranty Letter and shall only cover defects occurring within the stated warranty period.


2.4 SOLID’s obligation under this warranty is limited to replacement of the defective portion of the Product and does not extend to any form of financial compensation, reapplication costs, loss of use, or indirect damages.

3. CONDITIONS FOR WARRANTY VALIDITY

The warranty shall be valid only when the following strict conditions are fully met:

3.1 All Products must have been fully paid for by the Client and purchased directly from SOLID.


3.2 The Product must be used within its designated shelf life and stored under proper conditions.

3.3 The Product must be:

  • Transported, stored, and handled strictly in accordance with SOLID’s Technical Data Sheet (TDS) or official recommendations;
  • Applied only to compatible and stable substrates using methods and environmental conditions described in SOLID’s documentation or as advised by SOLID’s technical personnel;
  • Protected from any site conditions that may compromise product integrity, including but not limited to excessive humidity, direct UV exposure, poor ventilation, standing water, or surface temperatures outside typical application ranges (normally between 5°C and 40°C unless otherwise specified by SOLID).

3.4 The Product must not:

  • Be altered, diluted, repaired, or modified in any manner not authorized by SOLID;
  • Be applied to moving, unstable, or moisture-compromised substrates;
  • Be exposed to abnormal mechanical, chemical, or thermal stress during or after application.

3.5 The following conditions will automatically void the warranty:

  • Failure to properly prime or prepare the substrate in accordance with SOLID’s approved Method Statement and Technical Data Sheet (TDS);
  • Improper surface preparation that results in product failure, including application on contaminated, wet, oily, dusty, or unstable substrates;
  • Use of expired, improperly mixed, or diluted product, or failure to comply with the specified mixing ratios and instructions in the TDS;
  • Application by unqualified personnel or without written approval from SOLID;
  • Poor construction practices, structural flaws, or design defects, including but not limited to substrate instability, improper drainage, cracks, or movement joints;
  • Damage due to neglect, physical abuse, third-party interference, vandalism, abrasion, or any intentional or accidental misuse;
  • Contact with incompatible substances, including aggressive cleaning agents, solvents, or third-party product not approved by SOLID;
  • Exposure to natural disasters, including but not limited to earthquake, fire, flood, storm, hurricane, or other force majeure events;
  • Visual changes, including but not limited to discoloration, streaking, surface unevenness, patchiness, fungal or algal growth, or general aesthetic deterioration due to weathering, shall not be considered defects;
  • Cracking, debonding, blistering, or peeling resulting from substrate movement, thermal expansion, surface moisture, or architectural design flaws;
  • Damage caused by extreme weather conditions such as flooding, prolonged water immersion, excessive humidity, or moisture ingress exceeding tolerance;
  • Failure resulting from substrate contamination, including but not limited to oils, chemicals, laitance, or surface dust;
  • Use of the product for applications not specified in the TDS or outside intended purposes;
  • In the event that the quantity of goods purchased by the client does not meet the coverage requirements specified in the Technical Data Sheet (TDS).

3.6 SOLID shall not be responsible for removal, reapplication, or disposal costs under any circumstances.


3.7 Clients must take reasonable steps to prevent further damage once any defect becomes apparent.

4. MATERIAL WARRANTY & DEFECT CLAIM PROCEDURE

4.1 Clients are required to submit a formal claim to SOLID in either of the following instances:

  • Upon completion of the project, to activate and register the warranty; or
  • In the event of an alleged material defect during the warranty period.

4.2 All claims must be submitted in SOLID’s official website using the SOLID’s Warranty Claim Form, within:

  • Fourteen (14) calendar days of project completion, or
  • Seven (7) calendar days from the date the defect is discovered, whichever is applicable.

4.3 The Client must:

  • Provide supporting documents such as purchase orders (if any), acknowledged delivery orders and completion report with photographs which indicates the methodology steps followed;
  • Provide evidence of the alleged defects (if any);

4.4 SOLID will evaluate the submitted claim and determine its validity at its sole discretion. If approved, SOLID shall provide product replacement strictly limited to the affected portion of the Product.

4.5 SOLID’s determination regarding the claim, including the nature of the remedy, shall be final and binding. No labour, removal, or reapplication costs shall be borne by SOLID.

5. LIMITATION OF LIABILITY

5.1 SOLID’s liability under this warranty is strictly limited to replacement of the defective Product only.


5.2 Under no circumstances shall SOLID be held liable for:

  • Labour, removal, disposal, or reapplication costs;
  • Design, engineering, or construction flaws;
  • Indirect or consequential losses such as loss of profits, delay penalties, or third-party claims.

5.3 SOLID does not assume any responsibility for overall project success or for ensuring the performance of unrelated product or workmanship.

6. NON-ASSIGNMENT

6.1 This warranty is non-transferable. It may not be assigned, conveyed, or transferred to any other party without the prior written consent of SOLID.

7. GOVERNING LAW AND DISPUTE RESOLUTION

7.1 This warranty shall be governed by and construed in accordance with the laws of Malaysia.


7.2 Any disputes arising under or in connection with this warranty shall be referred to and finally resolved by arbitration in Selangor, in accordance with the Arbitration Act 2005. Arbitration proceedings shall be conducted in English.

8. ENTIRE AGREEMENT

8.1 This document constitutes the entire agreement between SOLID and the Client with respect to the Product warranty.


8.2 No representations, promises, or statements made by any party which are not expressly set out in this document shall be valid or enforceable.


8.3 Any amendments or deviations must be in writing and signed by a duly authorized representative of SOLID.

9. CLIENT ACKNOWLEDGEMENT

By reading and accepting these Product Warranty Terms & Conditions, the Client acknowledges that they fully understand and agree to be bound by all terms stated herein.
By proceeding to request a Product Warranty from SOLID, the Client confirms that they have reviewed and accepted the above conditions in full.
